One Year Old suffers violent child abuse; babysitter still not arrested

Oregon: Babysitter turned violent puts one-year-old through terrifying child abuse while parents are out for the night.

Joshua Marbury and Alicia Quinney enjoyed a night out together, leaving their 1-year-old son Jacob at home with a babysitter they they thought they could trust. When the couple came home that night, the baby was crying and the sitter was sleeping. The next morning is when things became terribly apparent as to what happened. Jacob woke up with dark marks on his face.?At first, Alicia thought Jacob?had marker on his face, because his face looked a little discolored, kinda like when a child plays with markers and gets the ink all over themselves. But then the couple learned the disturbing truth as they realized that one of the marks was shaped like a hand and none of the bruises washed off like marker ink would. Now the truth is apparent as to what really happened that night. Striking a 1-year-old this hard could lead to severe injuries or worse. Both parents were sick to their stomach.?Joshua and Alicia notified the police and awaited charges. But nothing happened. The babysitter roams freely and is not being held accountable for their actions in which they struck an innocent child. The charges were dropped by the authorities because a certain law makes it difficult to prosecute someone if the victim does not speak. In this case, the baby cannot talk or describe the incident and they stated that there's no way to tell if the babysitter intended for this to happen. One has to wonder why said law seems to protect people from harming those unable to speak, in particular, babies, old people, the deaf, and even animals. Two months after the incident, the babysitter still walks free, even after they admitted to the child abuse. The parents have taken to social media to get this case investigated further and hopefully reopened so justice will be solved. There's no reason to ever hit a baby. Babies have no clue what they're doing, they're experiencing their first years on this planet and learning everything. Joshua Marbury posted this on his Facebook, in apparent disgust at the lack of support from the police.

??we had a confession from the abuser saying they did it. STILL this person was not arrested because they had to build a case and a jury to find him guilty BEFORE they go to jail. ? After TWO months of waiting we only find out that charges are dropped BECAUSE my one year old cannot tell you verbally he was abused and my son did not show he was in pain OR that this person ?intentionally? did this. ? Yet a baby isnt held to the same standard because he cant talk???? Well neither can a dead body. THATS BLASPHEMY. You waited 2 months if not longer to tell us this???? Something needs to be done. NOBODY can just hit a child and more to just get away with it because the child cant verbally tell you.?

Joshua refers to a 2012 Oregon Court of Appeals ruling that?makes it extremely difficult to prosecute abusers if the victim cannot talk.

Oregon law requires that prosecutors?must prove?the victims of child abusers suffered a ?physical injury? and experienced ?substantial pain.? A subsequent ruling by the state Appeals Court added that the?victim must have also suffered an ?impairment of a physical condition? greater than welts, bruises, or shallow cuts.

We can see that the bruises show the 1-year-old suffered physical injury and substantial pain and the confession should be enough to punish the person who struck a one-year-old in the face. Who knows how many other babies this person will put through violent child abuse. Should the babysitter be arrested? What should their punishment be?
